All of our packages include 2 edited digital images that you select at the end of your shoot. We are so sure you are going to love your images and need more than 2. But, in the off chance, you can't find 2 images that you love? No problem!
Let us know, we will refund the photoshoot package that was purchased.
CANCELLATION/LATE ARRIVAL POLICY
All Bookings are Final
Cancellations cause an unpleasant hassle for everyone involved. We ask that you please schedule your appointment mindfully.
Once scheduled, your photographer, shoot stylist, image editor, and studio space are held for you. There are no reschedules permitted unless a new package is purchased.
Additionally, with 10 days or less notice to cancel, if you are more than 30 minutes late for your appointment, or if you miss your appointment, there is a $100 fee and your purchase is forfeit.
Please arrive on time so you don't miss out on any of the experience we are excited to create for you.
For all full price packages:
A non-refundable booking fee equal to 1/3 the package price is required to reserve your appointment time and for our team to prepare for your shoot
The remainder of your package balance is due 10 days prior to your shoot.
If balance is not received at this time your appointment will be cancelled.
All bookings are final and can not be rescheduled.
REFUND POLICY (SHOOT TIME)
If you’ve changed your mind on your shoot, refunds for our sale package (1 hour shoot + 2 edited images) will be processed within 14 days. Refunds will not be granted after 14 days or after an appointment has been scheduled.
All other packages:
A booking booking fee of 1/3 the package price is required and is not refundable.
REFUND POLICY (PRODUCTS)
Due to the nature of digital photography and product orders and the fact that all photographs may be viewed by the client on our website prior to purchase, and all products are custom designed for each individual, once orders have been placed, Three Boudoir has a strict NO REFUND/RETURN/EXCHANGE POLICY. Once a transaction has been processed, it is then considered non-refundable.
For ongoing training and development, managers or trainees may periodically virtually observe our photoshoots. If a manager will be observing your shoot, you will be notified in advance of your shoot.
MODEL RELEASE, Image Sharing & Privacy
A model release is provided via a survey following your shoot. This is where you say “yay” or “nay” to us sharing your images. If permission is given the Client(s) hereby grants to Three Boudoir and her legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of the Client or in which the Client may be included, for editorial, trade, advertising and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. The Client hereby releases Three Boudoir and her legal representatives and assigns from all claims and liability relating to said photographs.**
**Given the nature of boudoir photography, images are never used without The Client(s) specific written permission. Permission is given by The Client(s) in a separate document following your shoot once the gallery is made available.
Three Boudoir will not use your photos for any reason, ever, without your explicit written permission.
PAYMENT (Discounted & Full Price Packages and Gift Cards)
Discounted package (1 hour shoot +2 edited digital images):
As soon as you purchase, this package is paid in full. There are no additional fees to purchase this package. This discounted package may not be combined with any other sale, promotion, discount, code, coupon and/or offer, unless otherwise specified.
Full price packages:
For all other packages, we require a non-refundable booking fee equal to 1/3 the cost of the package. All final payments are required 7 days prior to your shoot. If payment is not received 7 days prior to your shoot date, your appointment will be cancelled and opened to others for booking.
Gift cards must be purchased in advance of your appointment. If a gift card is purchased during or after your appointment, it can not be applied to your recent or previous shoot. It can only be applied to future appointments.
EXCLUSIVITY (A.K.A NO CELL PHONE CAMERA'S)
In order for Client(s) to receive the best service and most compelling photos possible, Three Boudoir must be the exclusive professional photographer for the Boudoir Photography Session. No cell phone cameras or videos please.
LIMITED LIABILITY AND INDEMNITY
Three Boudoir takes the utmost care with respect to exposure, transportation, and processing the photographs. However, in the unlikely event that photographs have been lost, stolen, or destroyed for reasons within or beyond Three Boudoir’s control, Three Boudoir’s liability is limited to the return of all payments received for the Boudoir Photography Session. Client(s) agrees to indemnify and defend Three Boudoir against any and all third party claims, damages, costs, and expenses, including reasonable legal fees and expenses, arising out of incidents or damages resulting from Client(s) actions or omission during Boudoir Photography Sessions.
SHIPPING & Delivery
Client is responsible for shipping cost associated with any product returns or reshipment b/c incorrect address was supplied to us.
Once out for delivery we are NOT responsible for lost, stolen, or misplaced packages.
Please contact the delivery carrier to file a report and have the carrier identify next steps to recover your package. Please note we are not responsible to complete the action to recover your package.
PRODUCTS (UPON RECEIPT)
Upon receipt of products, Client(s) accepts all responsibility for archiving and protecting the photographs. Three Boudoir is not responsible for the lifespan of any media provided.
PRODUCTS (PAYMENT & DELIVERY)
We do not edit or begin working on your order until all purchased products have been paid in full.
Galleries cannot be combined from multiple shoots. I.e. images from two different shoots can not be used to create 1 album.
We keep all images for 3 months from your shoot date. For any products that you order, your favorite images must be selected for your order before we tearfully delete your images at the 3 month mark.
If images are not selecting within 3 months, don't worry! We know it can be hard to pick from so many incredible images. We'll help! We will select your images, edit, design and deliver your product before we permanently delete you photos.
If edited/designed product has been sent to you to proof/preview and we do not have requested changes from you within 30 days, we assume the preview we sent is finalized. We will send the edited/designed product to our printer and consider the project complete. Any changes requested after 30 days of preview or printing of product will incur additional charges.
BACK-UP OF IMAGES
Three Boudoir will attempt to maintain your images for 3 months following your shoot. Three Boudoir ensures the back-up of images through numerous means. However, Three Boudoir cannot guarantee maintaining the perpetual life of all images. Therefore, it is advised that once Client has possession of the images they are stored in a safe place, and if applicable, back-ups made of any digital purchased photo.
While Three Boudoir will make every reasonable effort to take photos specifically requested by Client(s), Client(s) understands that this is an uncontrolled event and that due the vagaries of the weather, available light, time restrictions, and willingness of subject(s), Three Boudoir does not guarantee all requested photos will be taken.
Images are edited at the Photographer’s discretion, and delivered prints may not include all images shot. Three Boudoir reserves the creative right to edit and release only those photos deemed creditable as professional in quality and within the photographer’s artistic standards.
EDITING + Album Design + Album Proofing
You are wonderful and whole exactly as you are, no editing required. However, when we talk about editing, we aren't only talking about the person in the photo. Editing applies to all sorts of image details, i.e. color correction, white balance, and removing distracting items from the background like wall outlets, light switches, wires, etc.
All product pricing (other than where noted in product description) include our standard/natural retouching.
Standard/Natural Retouching is included in all edited purchases. It includes adjusting the color, balance, brightness, and tone of the overall image. If items in the background are distracting, they will be removed (i.e. wall outlets, light switches, wires.) If needed, images will be cropped to draw the eye to specific areas of the photo. Finally, natural/standard retouching includes light skin corrections to include removing temporary blemishes and skin marks (i.e. bug bites +bruises), and blending to reduce under eye circles
Deluxe Retouching is available as an upgrade to all orders. It includes all of the features of natural retouching plus the removal of tags from clothing or from the bottom of shoes, additional skin retouching to address uneven skin tone, cellulite, scars, stretch marks, under eye bags, etc. Additionally deluxe retouching requests may include body, face, and hair alterations as well as makeup or outfit color changes.
All Album Designs: After initial design and album proofing by client one additional round of edits is included. Beyond that additional charges may apply.
Selecting Favorites for Your Order: We keep all images for 3 months from your shoot date. For any products that you order, you favorite images must be selected for your order before we tearfully delete your images at the 3 month mark. If images are not selecting within 3 months, don't worry! We know it can be hard to pick from so many awesome photos. We'll help! We will select your images, edit, design and deliver your product before we permanently delete you photos.
In cases where sessions are not booked in our studio or in a venue we select and book, it is the responsibility of the Client(s) to schedule and receive permission to use various locations for photography. If fees are required by a venue to reserve the location, it shall be Client(s) sole responsibility to pay for such fees and arrange for any necessary permits in advance.
Three Boudoir is the author of all images made hereunder and as provided for by United States Copyright Law. Three Boudoir shall retain the copyrights in perpetuity, regardless of possession or ownership of photographs, digital files or any other format of reproduction.
The Client is prohibited from altering the photographs in any way. This includes but is not limited to: cropping, converting color or any other means of changing the original artwork.
Upon final payment by the Client(s), limited copyright ownership of the resulting images will be transferred to the Client(s) under the following conditions: – The photographs are the property of Client for personal use and for the purposes of the reproduction and giving of photographs to friends and relatives. – Any photographs uploaded online will be clearly and distinctly attribute credit to “Three Boudoir”. – The Client(s) must obtain written permission from and compensate Three Boudoir prior to the Client(s) or its friends and relatives publishing or selling the photographs for profit, promotional or commercial use.
It is illegal to copy, scan, download, print, share, alter, or otherwise steal any image created by Three Boudoir during Client’s photo session. This applies to “sneak peek” images, images posted in an online proofing gallery, blog, Facebook, or hard copy images.
Three Boudoir may make updates to Fine Print occasionally. This Agreement incorporates the entire understanding of the parties. Any modifications of this Agreement must be in writing and signed by both parties.
